Welcome to Sushi Dojo. These Terms of Service (“Terms”) govern your use of the Sushi Dojo website, reservations, dining experiences, classes, events, retail purchases, online orders, and other products and services offered by Sushi Dojo (“Sushi Dojo,” “we,” “us,” or “our”).
By accessing our website, making a reservation, registering for a class or event, purchasing a product, placing an order, or otherwise using our services, you agree to these Terms. If you do not agree with these Terms, please do not use our website or services.
1. Restaurant Reservations and Dining
Reservations are subject to availability and are not guaranteed until confirmed through our designated reservation platform or directly by Sushi Dojo.
Guests are responsible for reviewing the date, time, party size, and other details of their reservation before confirming.
Certain dining experiences, including the Dojo Omakase, are offered at scheduled seating times. Guests should arrive promptly so that the experience may proceed as intended. Late arrivals may receive an abbreviated experience or may need to be accommodated at another available time, subject to availability.
Prices, menu items, ingredients, seating times, and availability are subject to change. Unless expressly stated otherwise, applicable taxes and gratuities are additional.
Cancellation, no-show, deposit, and refund policies presented at the time of booking are incorporated into these Terms and apply to the applicable reservation.
2. Menu, Seasonality, and Availability
Sushi Dojo works with seasonal and highly perishable ingredients. Menu selections, fish, beverages, ingredients, and individual courses may change without notice based on seasonality, quality, availability, and chef selection.
Photographs, descriptions, and other representations of food and beverages on our website or third-party platforms are illustrative. Presentation and ingredients may vary.
We reserve the right to modify, substitute, limit, or discontinue menu items at any time.
3. Allergies and Dietary Restrictions
Guests are responsible for informing Sushi Dojo of allergies and dietary restrictions before dining, preferably when making a reservation.
Although we will make reasonable efforts to address disclosed allergies and dietary needs, our kitchen handles fish, shellfish, soy, sesame, gluten, eggs, and other common allergens. Cross-contact may occur, and we cannot guarantee that any food or beverage is completely free from a particular allergen.
Because certain experiences are chef-selected, including the Dojo Omakase, some dietary restrictions or substitutions may not be accommodated. Guests with severe or life-threatening allergies should contact Sushi Dojo before making a reservation or placing an order to determine whether their needs can reasonably be accommodated.
4. Raw and Undercooked Foods
Sushi and other menu items may contain raw or undercooked seafood, shellfish, meat, or eggs. Consuming raw or undercooked foods may increase the risk of foodborne illness, particularly for individuals with certain medical conditions.
By choosing to consume raw or undercooked items, guests acknowledge the inherent risks associated with such foods.
5. Alcoholic Beverages
Alcoholic beverages are available only to guests who meet the legal drinking age and can provide valid identification when requested.
Sushi Dojo reserves the right to refuse or discontinue alcohol service when required by law or when, in our judgment, continued service would be inappropriate or unsafe.
Guests are responsible for consuming alcohol responsibly and arranging safe transportation when necessary.
6. Takeout, Pickup, and Delivery
Takeout, pickup, and delivery offerings are subject to availability and may differ from the dine-in menu.
Estimated preparation and delivery times are estimates only. Sushi Dojo is not responsible for delays caused by circumstances outside our reasonable control.
Orders placed through third-party delivery or ordering platforms may also be governed by the terms, fees, refund policies, and privacy practices of those platforms. Issues relating exclusively to a third-party platform may need to be resolved directly with that provider.
Guests are responsible for providing accurate order, contact, delivery, and allergy information.
Because food is perishable and prepared to order, completed food and beverage purchases are generally nonreturnable except where required by law or where Sushi Dojo determines that an order was incorrect or materially defective.
7. Classes, Workshops, and Culinary Education
Sushi Dojo may offer sushi-making classes, knife-skills instruction, cooking classes, cultural workshops, professional culinary training, and other educational experiences.
Participation may involve inherently hazardous activities and equipment, including sharp knives, kitchen tools, hot surfaces, raw seafood, food preparation equipment, and other conditions ordinarily associated with professional and recreational culinary environments.
Participants must follow all instructions provided by Sushi Dojo chefs, instructors, employees, and representatives and must use equipment only as directed.
Participants are responsible for disclosing relevant allergies, dietary restrictions, or other conditions that may affect their safe participation before the class or program begins.
Sushi Dojo may require participants to execute a separate acknowledgment of risk, release, waiver, or other participation agreement before participating. Refusal to complete a required agreement may result in the participant being unable to participate.
Sushi Dojo reserves the right to remove any participant whose conduct creates a safety concern or materially disrupts the experience.
Age restrictions, parental or guardian consent requirements, and supervision requirements may apply to certain classes.
8. Events and Private Dining
Private dining, restaurant buyouts, chef-led experiences, tuna-cutting experiences, corporate gatherings, celebrations, and other private events may be governed by additional written agreements.
Deposits, minimum spending requirements, cancellation terms, guest counts, menus, beverage packages, service charges, and other event-specific conditions will be communicated as applicable.
An event is not considered confirmed until all required agreements, deposits, or payments have been completed.
Event hosts are responsible for the conduct of their guests and for complying with applicable event policies.
9. Dojo Proshop and Retail Purchases
The Dojo Proshop may offer Japanese knives, sushi tools, chef supplies, sushi-making kits, ingredients, Shokunin products, apparel, merchandise, and other goods.
Product availability, specifications, packaging, pricing, and inventory may change without notice. We may limit quantities or cancel orders when inventory errors, pricing errors, suspected fraud, or other circumstances reasonably require us to do so.
Product photographs are intended to represent products accurately, but variations in materials, craftsmanship, finishes, packaging, and screen display may occur.
Certain professional knives and culinary tools are extremely sharp and may cause serious injury if handled improperly. Purchasers and users are responsible for safe handling, storage, maintenance, and use of these products and for keeping hazardous tools away from children and unauthorized users.
Products must be used only for their intended lawful purposes and in accordance with any manufacturer instructions.
10. Returns, Exchanges, and Refunds
Return and exchange eligibility for Proshop merchandise will be governed by the return policy displayed at the time of purchase.
For hygiene, safety, food-safety, or other legitimate reasons, certain products may be final sale, including opened food products, used culinary tools, customized items, and other goods identified as nonreturnable at the time of purchase, except where otherwise required by law.
Refunds for classes, events, reservations, and other experiences are governed by the cancellation or refund terms disclosed when the applicable booking is made.
Nothing in these Terms limits any rights that cannot lawfully be waived.
11. Shipping
If shipping is offered, estimated shipping and delivery dates are estimates and are not guaranteed.
Customers are responsible for providing a complete and accurate shipping address. Additional charges may apply when an order must be reshipped because incorrect information was provided.
Risk of loss, carrier responsibility, damaged shipments, international shipping, duties, and other shipping conditions may be governed by additional policies disclosed during checkout.
12. Gift Cards and Promotional Offers
Gift cards, promotional credits, discounts, and special offers are subject to the terms presented when issued or purchased and to applicable law.
Promotional offers may be subject to specific eligibility requirements, redemption periods, exclusions, or availability limitations.
Purchased gift cards will be administered in accordance with applicable law.
13. Safety and Conduct on Sushi Dojo Premises
Guests enter and use Sushi Dojo premises with an obligation to exercise reasonable care for themselves, accompanying minors, and their personal property.
Restaurant and culinary environments may contain conditions ordinarily associated with food-service establishments, including wet or recently cleaned floors, hot surfaces, sharp utensils, glassware, food and beverage spills, furniture, steps, equipment, and crowded service areas.
Guests must follow posted warnings and reasonable instructions from Sushi Dojo personnel.
Running, unsafe handling of equipment, unauthorized entry into employee-only or kitchen areas, harassment, threatening behavior, excessive intoxication, or conduct that creates a risk to guests or staff is prohibited.
Sushi Dojo reserves the right to refuse service or require a guest to leave when reasonably necessary to protect safety, comply with law, or preserve the dining environment.
Parents and guardians are responsible for appropriately supervising minors in their care.
14. Personal Property
Guests are responsible for their personal belongings while visiting Sushi Dojo.
To the fullest extent permitted by applicable law, Sushi Dojo is not responsible for lost, stolen, forgotten, or damaged personal property unless liability cannot lawfully be excluded.
15. Assumption of Inherent Risks
Certain activities and experiences offered by Sushi Dojo involve risks that cannot be completely eliminated, including risks associated with consuming raw or undercooked foods, food allergies, alcoholic beverages, handling knives and culinary tools, participating in cooking activities, and being present in an active restaurant or kitchen environment.
By voluntarily participating in an applicable activity, guests and participants acknowledge and accept the ordinary and inherent risks reasonably associated with that activity.
Nothing in this provision is intended to waive or limit liability that cannot lawfully be waived or limited.
16. Website Use
You may use the Sushi Dojo website only for lawful personal purposes.
You may not attempt to interfere with the operation or security of the website; gain unauthorized access to systems or accounts; introduce malicious code; scrape or harvest information through unauthorized automated means; impersonate another person; use the website for fraudulent activity; or misuse Sushi Dojo content, trademarks, reservations, promotions, or services.
We may suspend or restrict access when we reasonably believe these Terms have been violated.
17. Intellectual Property
The Sushi Dojo name, logos, branding, photographs, videos, menu designs, written content, graphics, recipes or proprietary materials where legally protectable, educational materials, and other original content are owned by or licensed to Sushi Dojo and are protected by applicable intellectual-property laws.
Except as expressly permitted, no Sushi Dojo content may be copied, reproduced, distributed, modified, commercially exploited, or used to create derivative materials without prior written permission.
18. Third-Party Services and Links
Our website may link to or integrate with third-party services, including reservation, payment, ordering, delivery, mapping, social-media, and other providers.
Sushi Dojo does not control those independent services and is not responsible for their availability, content, security, privacy practices, or independent acts or omissions.
Your use of a third-party service may be governed by that provider’s own terms and policies.
19. Pricing and Errors
We make reasonable efforts to maintain accurate prices, descriptions, availability, and other information. Errors may occasionally occur.
To the extent permitted by law, Sushi Dojo reserves the right to correct errors and to cancel or decline transactions affected by an obvious pricing, inventory, or technical error. If payment has already been collected for a transaction that we cancel, the applicable amount will be refunded.
20. Disclaimer of Warranties
To the fullest extent permitted by law, the website and online services are provided on an “as available” basis. Sushi Dojo does not guarantee that the website will always be uninterrupted, error-free, or free from harmful components.
Any warranties that cannot lawfully be excluded remain unaffected.
21. Limitation of Liability
To the fullest extent permitted by applicable law, Sushi Dojo and its owners, affiliates, employees, agents, and representatives will not be liable for indirect, incidental, special, exemplary, punitive, or consequential damages arising from the use of the website, third-party services, products, or experiences.
Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by applicable law.
Any separate release or waiver executed in connection with a class, event, or other activity will be governed by its own terms.
22. Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Sushi Dojo and its owners, affiliates, employees, agents, and representatives from claims, liabilities, damages, losses, and reasonable costs arising from your unlawful conduct, material violation of these Terms, misuse of our services or products, or infringement of another person’s rights.
This provision does not require you to indemnify Sushi Dojo for liability that cannot lawfully be shifted to you.
23. Privacy
Our collection and use of personal information is addressed in our separate Privacy Policy, which should be read together with these Terms.
24. Changes to These Terms
We may update these Terms periodically to reflect changes in our services, business practices, or applicable law.
25. Severability
If any provision of these Terms is determined to be unlawful or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as appropriate, and the remaining provisions will remain in effect.
26. No Waiver
A failure by Sushi Dojo to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.
27. Governing Law
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except where applicable law requires otherwise.
